# Mellow Miles Beta License Agreement

## 1. ACCEPTANCE OF TERMS
By installing, accessing, or using the Mellow Miles beta application (the "Beta App") through Apple's TestFlight program, you ("Tester," "you," or "your") agree to be bound by this Beta License Agreement ("Agreement"). If you do not agree to these terms, do not install or use the Beta App.
This is a **pre-release beta version** of Mellow Miles. The Beta App is provided for testing and feedback purposes only and is not intended for production use.
This Agreement is provided for informational purposes and does not replace Apple's TestFlight terms or any other terms you have accepted with Apple.

## 2. BETA LICENSE GRANT
**2.1 Limited License**
Subject to your compliance with this Agreement, Mellow Miles ("we," "us," or "Company") grants you a limited, non-exclusive, non-transferable, revocable license to:
- Install and use the Beta App on devices you own or control
- Test the Beta App's features and functionality
- Provide feedback to improve the Beta App
**2.2 Restrictions**
You may NOT:
- Distribute, sell, lease, or sublicense the Beta App
- Reverse engineer, decompile, or disassemble the Beta App
- Use the Beta App for commercial purposes
- Remove or modify any proprietary notices
- Share your TestFlight invitation with others
**2.3 Termination**
This license automatically terminates when:
- The beta testing period ends
- We release the production version
- We revoke your TestFlight access
- You violate this Agreement

## 3. BETA SOFTWARE DISCLAIMER
**3.1 "AS-IS" Provision**
THE BETA APP IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND. You acknowledge and agree that:
- The Beta App is **incomplete, unfinished software** under active development
- The Beta App may contain **bugs, errors, and defects** that could cause system failures, data loss, or crashes
- Features may be **added, changed, or removed** without notice
- The Beta App may have **limited functionality** compared to the final release
- Performance may be **unstable or inconsistent**
**3.2 No Warranties**
WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:
- MERCHANTABILITY
- FITNESS FOR A PARTICULAR PURPOSE
- NON-INFRINGEMENT
- ACCURACY OR RELIABILITY OF DATA
- UNINTERRUPTED OR ERROR-FREE OPERATION

## 4. PRIVACY & DATA COLLECTION
**4.1 Beta Testing Data Collection**
During the beta period, we may collect additional diagnostic data to help us improve stability, performance, and reliability.
**Automatically Collected:**
- Crash reports and stack traces
- App performance metrics (CPU, memory, battery usage)
- Device information (model, iOS version, screen size)
- Feature usage analytics (for example, which screens you visit, taps/navigation)
- Network request logs (API calls, response times, error codes)
- TestFlight-related testing metadata that Apple makes available to developers (for example, build version and basic session signals)
**Driving/Trip Data (Feature-Dependent):**
- GPS location data during tracked drives (if you enable trip tracking)
- Motion sensor data (for example, accelerometer/gyroscope) during tracked drives
- Heart rate data (if a supported wearable is connected and you explicitly authorize access)
- Reflections and notes you enter post-drive
- Optional self-logged events (only if you choose to record them)
- Trip metadata (start/end times, distance, duration)
**4.2 Privacy Protections**
- We use industry-standard security controls to protect data in transit and at rest where supported by our infrastructure providers.
- Access controls are designed to prevent access to other users' data.
- We do not sell your personal data.
- You can request data export or deletion via the app or by contacting us.
**4.3 No In-Drive Prompts**
Mellow Miles is designed to avoid prompting emotions during drives. Reflections are user-initiated post-trip.
**4.4 Data Retention (Beta Period)**
Retention can vary by feature and region. If retention controls are available in your build, those settings apply. Otherwise, we retain data only as long as reasonably necessary for: (a) providing the Beta App, (b) security/fraud prevention, and (c) improving reliability during the beta.
**4.5 Production Migration**
When the Beta App transitions to production:
- Your account and driving data will be **preserved**
- You can continue using the same account
- Beta-specific diagnostic data may be reduced or deleted when no longer needed for beta support
- Standard production privacy policy will apply

## 5. DRIVING SAFETY & HEALTH DISCLAIMERS
**5.1 Not a Substitute for Medical Care**
THE BETA APP IS NOT A MEDICAL DEVICE AND DOES NOT PROVIDE MEDICAL ADVICE, DIAGNOSIS, OR TREATMENT.
- Heart rate monitoring is for informational purposes only
- Emotion tracking is not a diagnostic tool for mental health conditions
- Always consult qualified healthcare professionals for medical concerns
- In a mental health crisis, contact emergency services (988 Suicide & Crisis Lifeline in the US)
**5.2 Driving Safety Warning**
YOU ARE SOLELY RESPONSIBLE FOR SAFE VEHICLE OPERATION.
- **Never interact with the app while driving**
- The app should run in the background during drives
- Reflections and any logging should only occur when safely stopped
- Speed limit warnings are estimates and may be inaccurate
- Always obey posted traffic laws and signals
**5.3 OBD-II Adapter Risks**
If your build includes optional OBD-II features and you choose to use them:
- Compatibility is not guaranteed across all vehicles/adapters.
- Use only reputable adapters and follow the manufacturer's instructions.
- Third-party adapters are used at your own risk; disconnect the adapter if you notice vehicle issues.
- We are not responsible for vehicle damage caused by third-party adapters.

## 6. FEEDBACK & INTELLECTUAL PROPERTY
**6.1 Feedback License**
By providing feedback, suggestions, bug reports, or feature requests ("Feedback"):
- You grant us a **perpetual, worldwide, royalty-free, irrevocable license** to use, modify, and incorporate your Feedback
- You waive any claims to ownership or compensation for implemented Feedback
- We are not obligated to implement or respond to Feedback
**6.2 Confidentiality**
The Beta App is pre-release software. Please help us keep the beta orderly by not sharing:
- TestFlight invitation codes
- Unreleased features, screenshots, or performance claims that could be misleading during active development
**Exception:** You may discuss your general experience with the app without revealing unreleased features.
**6.3 Our Intellectual Property**
All rights, title, and interest in the Beta App, including code, design, trademarks, and documentation, remain our exclusive property.

## 7. LIMITATION OF LIABILITY
**7.1 Maximum Liability**
TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM THIS AGREEMENT OR THE BETA APP SHALL NOT EXCEED **$100 USD**.
**7.2 Exclusion of Damages**
WE SHALL NOT BE LIABLE FOR:
- **Indirect, incidental, special, consequential, or punitive damages**
- Loss of profits, revenue, data, or business opportunities
- Cost of substitute goods or services
- Property damage, personal injury, or death
- Vehicle damage resulting from OBD-II adapter use
- Data loss or corruption
- Accidents or traffic violations while using the app
**7.3 Beta Software Acknowledgment**
You expressly acknowledge that:
- The Beta App is experimental and may cause device malfunctions
- You assume all risk of using pre-release software
- You will not rely on the Beta App for critical functions
- You will back up your data before using the Beta App

## 8. INDEMNIFICATION
You agree to indemnify, defend, and hold harmless Mellow Miles, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including attorney fees) arising from:
- Your use or misuse of the Beta App
- Your violation of this Agreement
- Your violation of any law or third-party rights
- Accidents or incidents occurring while using the Beta App
- Damage to vehicles or property related to OBD-II adapter use

## 9. BETA TESTING REQUIREMENTS
**9.1 Eligibility**
To participate in the beta program, you must:
- Be at least 18 years old
- Have a valid driver's license (if testing driving features)
- Own or have authorized access to the devices you test on
- Agree to provide constructive feedback
**9.2 Beta Tester Obligations**
You agree to:
- Test the Beta App regularly and report bugs via TestFlight or support@mellowmiles.app
- Provide detailed reproduction steps for crashes or errors
- Respond to surveys or feedback requests (when possible)
- Use good judgment: do not rely on beta software for critical needs
**9.3 Beta Termination**
We reserve the right to terminate your beta access at any time for:
- Violation of this Agreement
- Abusive or fraudulent behavior
- Failure to provide feedback over an extended period
- End of the beta testing period

## 10. GOVERNING LAW & DISPUTE RESOLUTION
**10.1 Governing Law**
This Agreement shall be governed by the laws of the **State of California, United States**, without regard to its conflict of law principles.
**10.2 Arbitration**
Any disputes arising from this Agreement shall be resolved through **binding arbitration** under the rules of the American Arbitration Association (AAA), except:
- You may bring claims in small claims court
- We may seek injunctive relief for intellectual property violations
**10.3 Class Action Waiver**
You agree to resolve disputes on an **individual basis only**. You waive the right to participate in class actions, class arbitrations, or representative proceedings.
**10.4 Jurisdiction**
If arbitration does not apply, you consent to the exclusive jurisdiction of courts in **San Francisco County, California**.

## 11. GENERAL PROVISIONS
**11.1 Entire Agreement**
This Agreement constitutes the entire agreement between you and Mellow Miles regarding the Beta App and supersedes all prior agreements.
**11.2 Modifications**
We may modify this Agreement at any time by:
- Posting an updated version in the Beta App
- Sending you an email notification
- Updating this document with a new "Effective Date"
Continued use of the Beta App after modifications constitutes acceptance.
**11.3 Severability**
If any provision of this Agreement is found invalid or unenforceable, the remaining provisions shall remain in full effect.
**11.4 No Waiver**
Our failure to enforce any provision does not waive our right to enforce it later.
**11.5 Assignment**
You may not assign this Agreement. We may assign it without your consent.
**11.6 Export Compliance**
You agree to comply with all U.S. export control laws and not export the Beta App to prohibited countries or persons.

## 13. ACKNOWLEDGMENT
By clicking "Accept" or using the Beta App, you acknowledge that:
- You have read and understood this Agreement
- You agree to be bound by its terms
- The Beta App is pre-release software provided "as-is"
- You will not rely on the Beta App for critical functions
- You assume all risks associated with beta testing
- Your data may be collected for testing, diagnostics, and improvement
- You are responsible for safe driving and will not use the app while driving
